Delaware Appeals Sports Betting Case
As expected, Delaware will appeal its sports betting case to the full, 12-member Third Circuit US Court of Appeals.
Delaware has important legal and factual questions and that deserve to be heard by the full court, Gov. Jack Markell said.
A three-member panel of the Third Circuit threw out Delaware’s sports betting ambitions last month saying the state could only offer the kinds of betting grandfathered into federal law – parlay bets on NFL games.
Among the issues Delaware is expected to raise is whether it can offer the same game but on other sports.
Delaware also has argued that sports betting can be defined as a lottery, which is legal under the state constitution, because of the element of chance involved.
Meanwhile, the first full NFL Sunday saw about 200 people each watch football games at the new sports books at Delaware Park and Dover Downs, the Wilmington News Journal reported.
